DMCA Copyright Policy

HappyFace respects the intellectual-property rights of others and expects its users to do the same. Happyface Platform Inc. is a Canadian federally-incorporated entity, but because the Service is available to users in the United States via the Apple App Store and Google Play, we maintain a copyright takedown process modeled on the Digital Millennium Copyright Act of 1998 (the "DMCA"), 17 U.S.C. § 512. We will respond expeditiously to claims of copyright infringement that are reported to our designated copyright agent identified below.

How to submit a takedown notice

If you believe content available on the Service infringes your copyright, please send a written notice to our designated agent. To comply with 17 U.S.C. § 512(c)(3), your notice must include all of the following:

  1. A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  2. Identification of the copyrighted work claimed to have been infringed (or, if multiple works at the Service are covered by a single notice, a representative list of such works).
  3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access disabled, with information reasonably sufficient to permit us to locate the material (e.g. the URL of the post or profile).
  4. Information reasonably sufficient to permit us to contact you, such as an address, telephone number, and email address.
  5. A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Send your notice to dmca@happyface.io or by post to the address above. We aim to acknowledge complete notices within 24–48 hours and act on them promptly.

Warning. Under 17 U.S.C. § 512(f), you may be liable for damages, including costs and attorneys' fees, if you knowingly misrepresent that material is infringing.

Counter-notice procedure

If you believe content of yours was removed by mistake or misidentification, you may file a counter-notice with our designated agent. To comply with 17 U.S.C. § 512(g)(3), your counter-notice must include:

  1. Your physical or electronic signature.
  2. Identification of the material that was removed and the location where it appeared before removal.
  3. A statement under penalty of perjury that you have a good-faith belief the material was removed as a result of mistake or misidentification.
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if outside the United States, the courts of the Province of Ontario, Canada), and that you will accept service of process from the person who provided the original notice or an agent of such person.

Upon receipt of a valid counter-notice, we will forward it to the original complainant. If the complainant does not file a court action seeking a restraining order against you within 10–14 business days, we may restore the removed material.

Repeat-infringer policy

In accordance with 17 U.S.C. § 512(i), we maintain a policy of terminating, in appropriate circumstances and at our discretion, the accounts of users who are determined to be repeat infringers. We track per-account copyright strikes and may suspend or permanently terminate accounts that accumulate repeated valid complaints.
